Statutory Power of Sale & Enjoinment Protocols (2026)
The Enjoinment Clock: No Automatic Court Oversight
The Reality: New Hampshire uses a "Power of Sale" clause, meaning the bank does not need to sue you to take your home. Your only legal remedy to stop a sale is to file a Petition to Enjoin Foreclosure in Superior Court. If you do not act before the auction, you lose the "Right of Redemption" forever—NH does not allow you to buy the home back after the sale.

The New Hampshire "Fast Track" Timeline
In New Hampshire, the timeline from the first notice to the loss of your home can be as little as 45-60 days once the federal 120-day waiting period expires.
| Stage | Timing | The Authority Detail |
|---|---|---|
| Notice of Sale | 45 Days Before Sale | Lender must send notice via certified mail. This is your cue to file a Petition to Enjoin. |
| Public Advertisement | 3 Weeks Before | Sale must be advertised in a local newspaper once a week for 3 consecutive weeks. |
| The Auction | Day 45+ | Typically held on the property (your front lawn). The highest bidder takes immediate equitable title. |
| Deed Recording | Within 60 Days | The new owner has 60 days to record the deed. Title is not fully "clean" until this happens. |
Authority FAQ: New Hampshire 2026
What is the 2026 Homestead Exemption change?
As of January 1, 2026, New Hampshire dramatically increased the Homestead Exemption to $400,000 per person (capped at $550,000 for all owners). While this protects your equity from unsecured creditors, it does not stop a mortgage company from foreclosing on a default.
Can the bank sue me for a deficiency in NH?
Yes. If the auction price doesn't cover the debt, the lender can sue you for the "deficiency." However, under NH RSA 508:6, the lender must prove they made every "reasonable effort" to obtain a fair price at the sale. If they bid too low, you can challenge the deficiency amount.
Do I have a Right of Redemption after the sale?
No. New Hampshire is a "strict" non-judicial state. Once the auctioneer says "Sold," your right to reclaim the property is gone. You must reinstate or pay off the loan before the auction occurs.
